ALL OCCUPIED UNITS MUST HAVE ELECTRICAL SERVICE:

All occupied units must have electrical service provided by the Association or the authorized provider. The use of generators, candles, or other open firee as a substitute for electricity is not acceptable. If service is interrupted due to non-payment of Association fees or electrical charges, the owner will have 24 hours to restore the service before the initial fine will be assessed. A fine of $75 per week will be assessed until the power is restored, or the unit is vacated.

Prior Notice/Lease/Sales Procedure:

Required Lease Provision - Every lease (or sublease) of a Condominium Unit shall be subject to the following terms and provisions"

1. All leases shall be in writing;

2. No lease shall be for transient or hotel purposes:

3. No lease shall cover less than the entire Condominium Unit:

4. Unless otherwise permitted in writing by the Board of Directors, no lease shall be for an initial term of less that six (6) continuous months;

5. All prospective tenants shall be required to complete an application before occupancy. The application will be turned in to the management company along with the fee for the screening service for a conviction check. The fee will be the cost of the screening fee plus a $2.00 Association charge with is applied to the annual service renewal fee. (For example: at this time the company that will be conducting the conviction check is charging $18.00. The owners total costs will be $20.00. The Association reserves the right to use alternative services and the cost may vary some from $18.00). The management company shall have two business days in which to report the findings to the owner.  Conviction of a felony crime, or fortitude shall be grounds for denial of occupancy. Additional screening services such as credit history and rental history shall be available for a nominal fee. Contact the management company for a list of other screening services.

VEHICLES AND PARKING

Condition of Vehicle:

All vehicles parked on the property must be operable and contain the following: a valid license plate, a valid registration, a valid state inspection sticker, and any other permit or license as required by the State of Texas. All vehicles parked on the property in the designated parking spaces must appear to be in good working and operaable condition.  No vehicles or vehicles carrying garbage, trash, recyclable items, or hazardous substances are allowed to remain on the property. A vehicle in violation of any or all of the above requirements is subject to being towed from the property without notice at the vehicle owners's sole expense.

Parking Permits:

All residents, owners, and visitor vehicles that enter through the gates must have a Westbury Square Parking Permit or a Temporary Hang Tag. The Permanent Permit must be displayed in the lower corner of the back window on the drivers side. The Temporary Hang Tag must be displayed from the rearview mirror. Residents who do not want to affix a permanent sticker to his/her vehicle may use a Temporary Hang Tag. Parking Permits may be obtained from the management company during regular business hours. One free Permenant Parking Permit is issued per bedroom. One free Temporary Hang Tag is issued per unit. All additional tags are $10.00 and may be purchased from the managing agent.

Assigned Parking:

(Does not apply to the parallel visitor parking on the Chimney Rock Drive) All owners are responsible for their parking spaces. Vehicles in violation of the parking rules are subject to being towed from the property without notice at the owners expense. All vehicles must be in compliance with the Condition of the Vehicles as described in the Rules and Regulations and display the proper parking tag or permit.

Other Parking Violations:

All motorized vehicles must be parked in authorized parking spaces only. Parking spaces are not to be used for storage of vehicles, boats, campers, trailers, etc., and therefore subject to being towed without notice at the owners expense. The unit responsible for the parking violation is subject to be fined for violation of the parking rules and regulations. Any vehicle not parked in a clearly marked and authorized parking space is subject to immediate towing from the property without notice at the owners expense.
